If a passenger wants to sue a cruise line, where should the lawsuit be brought?

View More FAQ Videos

Transcript

The location where a lawsuit needs to be brought based upon a cruise ship entry depends upon the cruise ship ticket. Every single cruise ship ticket contains what’s called a Forum Selection Clause. That is a contractual term that says if you were injured during your vacation, you will bring the lawsuit in a particular county or a particular court. The cruise ship injury is very good at this and therefore they ensure that you either bring your lawsuit in San Diego, in Seattle, or mostly in Miami, Florida.

That’s important because most cruise ship passengers don’t live in Florida, or Seattle, or even California. They come from around the country and from around the world. Therefore, it’s important that you find an attorney in one of those locations. South Florida, Washington, or California so that you can ensure that your rights are fully protected.
