This February during Hit-and-Run Awareness Month, we remind you of the importance of hiring a personal injury attorney who knows the ins and outs of insurance coverage.
If you are hit by an uninsured motorist or a phantom vehicle that flees the scene, you may think you’re out of luck. You may be, but if you have the protection of uninsured/underinsured motorist coverage (UM), you can make a claim under that coverage.
We highly recommend this valuable coverage given the very high number of uninsured/underinsured drivers here in South Florida – basically, every other vehicle on the road.
Now, what if you did not purchase UM coverage? Are you also out of luck? Again, you may be, but our lawyers are very skilled in finding coverage that many other lawyers miss.
For example, a case currently being handled by Shareholder Mickey Smith and Attorney Chuck Geary involves a motorist who has no bodily injury coverage whatsoever. Our client’s insurance paperwork indicated that UM coverage had not been purchased. However, Mickey and Chuck required the insurer to produce documentation that this coverage had affirmatively been rejected, as required by Florida Law.
We kept the insurance company’s feet to the fire, and they ultimately admitted they could not prove our client had rejected this coverage and extended $200,000 of UM coverage – even though our client never paid a penny for any such coverage.
While this is not the norm, we are typically able to obtain UM coverage under these circumstances for our clients multiple times a year.
