Charles Stubbs — an American hero and, more importantly, a devoted father of three, including one child with special needs — was rear-ended by a tractor trailer on Oct. 4, 2023. The crash left him with a serious low back injury that required surgery. The tractor trailer’s insurance carrier disputed the claim, arguing that his back surgery was unrelated to the crash due to a prior herniation at the same level that had previously been operated on.
Joe Landy strategically countered this defense, arguing that following his earlier surgery, Charles had returned to active duty in the Air Force and successfully completed an overseas mission. This clearly demonstrated that his prior operation was effective, and that the second surgery was a direct result of the October 2023 crash.
Beyond the medical arguments, Joe highlighted the profound impact of Charles’s injuries on his family life. Leveraging his deep experience in cases involving families with special needs, Joe educated both the insurance carrier and defense counsel about the unique challenges Charles faced. This advocacy compelled the carrier to tender its $1,000,000 policy limits, reduced only by a nominal property damage payment.
