“There’s a general principle of law: as a company, you have to look out for the safety of someone who may come on your premises, and your premises can be extended by where you allow your passengers or customers to go,” Lesser said. Lesser also noted the unique legal considerations in cruise ship cases.
“What people don’t necessarily realize is that cruise ship cases are different. In the event of a rape or sexual assault or any type of cruise ship case, the statute of limitations is different. The period of time that you have to bring your lawsuit or settle your case—or be barred as a matter of law—is determined by your cruise ship ticket. That ticket outlines how long you have to sue, the venue and jurisdiction where you can bring that lawsuit, and that controls the whole case. People who may have a potential claim against a cruise ship company should look at that ticket and call a lawyer quickly to make sure their rights are protected,” Lesser said.
